Terms of Service

These Terms of Service ("Terms") govern your access to and use of the services, website, and client portal provided by Edwards Tech Innovation operating as Edwards Tech Innovation ("we," "our," or "us"). By creating an account or using our services, you agree to these Terms.

If you do not agree, please do not use our services.

1. Service Description

Edwards Tech Innovation provides residential and small business IT support services in the Peoria, Illinois area, including but not limited to: device troubleshooting and repair, network setup, software installation and configuration, virus and malware removal, data backup, and general technology consulting.

Services are delivered in-person, remotely, or through our online client portal depending on the nature of the request and your subscription plan.

2. Account Responsibilities

By creating an account, you agree to:

• Provide accurate and complete registration information
• Keep your password secure and not share your account credentials with others
• Notify us immediately at support@edwardstechinnovations.com if you suspect unauthorized access to your account
• Be responsible for all activity that occurs under your account
• Use the portal only for lawful purposes and in accordance with these Terms

3. Subscriptions and Billing

Subscription plans are billed monthly in advance. By subscribing, you authorize us to charge your payment method on a recurring monthly basis until you cancel.

• Auto-renewal — your plan renews automatically each billing cycle unless you cancel before the renewal date.
• Cancel any time — you may cancel your subscription at any time from your portal billing settings. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused days.
• Plan changes — upgrades take effect immediately and are prorated. Downgrades take effect at the next renewal.
• Overages — support hours used beyond your plan's included hours are billed at the per-hour rate stated in your plan, invoiced at the end of the billing cycle.
• Failed payments — if a payment fails, we will retry it and may suspend your account until the balance is resolved.

All prices are in USD. We reserve the right to change pricing with 30 days' advance notice.

4. No Fix, No Fee Guarantee

For pay-per-incident services (not covered under a subscription), you will not be charged a diagnostic or labor fee if we cannot resolve your issue. This guarantee applies to software and configuration issues where no hardware replacement is required. Diagnostic fees for hardware assessment may apply and will be disclosed in advance.

This guarantee does not apply to situations where the issue is resolved but then recurs due to user actions, hardware failure, or third-party software changes after our service visit.

5. Service Area

On-site services are available in Peoria, East Peoria, Peoria Heights, and West Peoria, Illinois. Extended service area coverage (Dunlap, Chillicothe, Washington, Morton, Bartonville, and Creve Coeur) is available with a travel fee. Remote support is available to all clients regardless of location.

We reserve the right to decline on-site service requests outside our service area.

6. AI Tech Assistant Disclaimer

Our client portal includes an AI-powered Tech Assistant. This tool is provided as a convenience to help answer common technology questions and assist with basic troubleshooting.

• AI responses may be inaccurate, incomplete, or outdated. Do not rely on them as a substitute for professional IT advice.
• Always verify AI suggestions before making changes to critical systems, deleting data, or modifying security settings.
• Edwards Tech Innovation is not liable for any loss or damage resulting from actions taken based on AI assistant responses.
• AI chat conversations may be processed by Anthropic's API as described in our Privacy Policy.

7. Limitation of Liability

To the fullest extent permitted by law, Edwards Tech Innovation shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to loss of data, loss of profits, or business interruption, even if we have been advised of the possibility of such damages.

Our total cumulative liability to you for any claims arising under these Terms shall not exceed the total amount you paid to us in the three months preceding the event giving rise to the claim.

We strongly recommend maintaining regular data backups. We are not responsible for data loss resulting from hardware failure, malware, accidental deletion, or services performed by third parties.

8. Termination

Either party may terminate the service relationship at any time. You may close your account from your portal settings or by contacting us. We reserve the right to suspend or terminate your account without notice for:

• Violation of these Terms
• Non-payment of amounts owed
• Abusive, threatening, or fraudulent behavior

Upon termination, your access to the portal will be revoked. Data deletion is governed by our Privacy Policy.

9. Disclaimer of Warranties

Our services are provided "as is" without warranties of any kind, express or implied. We do not guarantee that our services will be uninterrupted, error-free, or that all issues will be resolved. Technology is unpredictable, and outcomes depend on many factors outside our control.

10. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or via a notice in the portal at least 14 days before the changes take effect. Continued use of our services after the effective date constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to its conflict of laws provisions. Any disputes arising under these Terms shall be resolved in the courts of Peoria County, Illinois.
